All five remaining judges on the Constitutional Court will need to vote in favor in order to bring down the contested 2017 election of Talat Xhaferi as Speaker of Parliament.

The court unexpectedly put the long delayed case on the agenda, at a time when it can barely operate due to unfilled vacancies caused by retirements. It’s seen as a form of pressure from court President Dobrila Kacarska against Xhaferi, who is still Speaker and hasn’t been able to get a Parliament Committee to move on electing new judges.

In the unlikely case Xhaferi’s election in 2017, which sparked a major incident in the Parliament, is struck down, it’s possible that hundreds of subsequent decisions by the Parliament are also declared null. This, of course, includes the imposed Prespa Treaty. The challenge was presented by protets organizers Bogdan Ilievski and Boris Damovski, the World Macedonian Congress and other activists and lawyers.
