In Article 99 of the Venice Commission’s unofficial draft opinion on the 2018 Law on the Use of Languages, the Commission considers that “many provisions of the Law on Languages (from 2018) go beyond European standards as defined in particular in the Framework Convention for the Protection of National Minorities and the European Charter for Regional and Minority Languages ”.

According to analyst Naser Ziberi, however, the Venice Commission has a wrong approach toward the Albanian language as a minority language in this assessment. As he explains on TV21 show, in Amendment 5 of the Constitution, the Albanian language is not treated as a minority language, but on the contrary, as a language equal to Macedonian on all grounds except two, provided by the Constitution. Therefore, the Venice Commission cannot “measure” the Law on the Use of Languages, ie Albanian language, according to the parameters of the conventions on ethnic minorities.
